Is obama Impeachable?

Yes, in fact it is quite easy to impeach obama under the "high crimes and mistiminors" clause, see Summary and legal sections below.

Will it do any good to Impeach Obama?

However, what good will it do, if he is not removed from office.  President Bill Clinton was impeached, by the house, but never removed from office because there was not 2/3s votes in the Senate necessary.

Today, the situation looks quite simular, so this probably is an excersize of futility, unless many democrats cross party lines to vote for impeachment.  It would also require the likes of some "Rhinos" like Senator John McCain actually vote with the repubilcan party for a change.

What needs to happen?

The Senate will be the "hard" sell, so it would be best to put the cart can go before the horse. Or in other words can the Senate begin Impeachment proceedings before the House draws up the articles of impeachment?

Much like obama's whitepapers, the justification lies in the fact that taxation without representation can't occur.  Well, if that were truly the case, then the Senate could not have already voted on and approved SB 88, the online internet tax bill that passed through the senate on our about 5/5/2013

Call your Senator and DEMAND impeachment proceedings begin immediatly for obama.

Is obama in fact guilty of any crime?  Well one of the McCain's aids tried to tell me that I didn't know what I was talking about and there is nothing obama could be impeached for at this time.

Quite frankly "this person right out lied" to me.  Of course they want us to:
  • forget that WE THE PEOPLE are a Republic and the Senate represents the people of the State that they are ellected for
  • believe that obama can't be found gulty because it appears that he has "insolated" himself with people to take the fall and blame everyone except for himself.
  • Even if we can't impeach obama for "Treason" or "Bibery" it is a fact that we can impeach under "High Crimes and Misdermeanors". This was left intenationally vague, for circimstances exactly like this
All bread crumbs lead to obama. Lets talk about some of the issues:
  • Fast and Furious
  • Benghazi
  • AP Phone Taps
  • IRS targeting groups with Patriot or Tea Party in their names
Lets protend for a minute that obama is just incopentent, nothing more. Which I find complete and utter BS. He still can be impeached under "High Crimes and Misdermeanors".  Have you ever went before a Judge and they inform you "Igorance is not a defense"?  The beauty of this rule is the catch all for when people like obama has done what he has but yet there is not a "clean" path.

Will the Senator listen to me and what more can I do?

If enough people call, they may get the hint.  However, I think it probably won't be enough.

This is whay in additon to this I will be increasing my deductions to a level that will effectivly cut off my taxes begining on June 2013.  There was already another group that was planning on stopping paying taxes on the 4th of July, 2013.

What is the impact of not paying your taxes / increasing you deductions?

I don't have these answers.  I recommend you talk to your accountant before doing something like this.

I am hoping that after a couple of months if enough people do this, the message will be received loud and clear and congress will really take action.  If not they will continue business as usual.

Frankly, I am willing to sacrifice paying a fee, if necessary for not paying the government in full before 4/15/2014.

NOTE: If you do this PLEASE, put that money away in an account and don't touch it so that when April 15th, 2014 comes around, you have the money to pay the IRS.

SUMMARY: Articles of Impeachment for obama

Below I have outlined the U.S. Constitution on Impeachment of the executive branch.  To get to the point, there are 3 items which will qualify a person for impeachment.

The first two we have clear definitions for.  They are: Treason and Bribery. I hope I captured "Black's Law Dictionary" for these two items, since this is the dictionary used by lawyers and such.

The third item is "High Crimes and Misdemeanors".  This has no single definition, which was added as a catch all for "other" issues yet to be "discovered" and this was left to be interpreted as necessary.

So even if it can't be proved that obama committed Treason or Bribery, it will be quite easy to get him for "High Crimes and Misdemeanors".

Instead of building a list of all that he can be charged with, let me provide a list of a few websites that have a running tab going.

Ok, i included this last one, just because I thought thge number was funny:

Legal definitions (FYI)

U.S. Constitution - Article 2 Section 4

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

Treason:

The offense of attempting to overthrow the government of the state to which the offender owes allegiance; or of betraying the state into the hands of a for- eign power. Webster. In England, treason is an offense particularly directed against the person of the sov- ereign, and consists (1) icompassing or imagining the death of the king or queen, or their eldest son and heir; (2) in violating the king’s companion, or the king’s eldest daughter unmarried, or the wife of the king’s eldest son and heir; (3) in levying war against the king in his realm; (4) in adhering to the king’s enemies in his realm, giving to them aid and comfort in the realm or elsewhere, and (5) slaying the chancellor, treasurer, or the king’s justices of the oue bench or the other, justices in eyre, or justices of assize, and all other justices assigned to hear and determine, being in their places doing their offices. 4 Steph. Comm. 1S5-103; 4 Bl. Comm. 76-84. “Treason against the United States shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort.” U. S. Const, art 3,

See definition of Treason at: Law Dictionary: TheLawDictionary.Org - Treason

Bribery:

Bribery -  The offering, giving, receiving, or soliciting of any item of value to influence the actions of an official or other person in discharge of a public or legal duty.

The bribe is the gift bestowed to influence the recipient's conduct. It may be any money, good, right in action, property, preferment, privilege, emolument, object of value, advantage, or merely a promise or undertaking to induce or influence the action, vote, or influence of a person in an official or public capacity.

High Crimes and Misdemeanors:

This third item, was added because George Mason contended that "treason or bribery" was too narrow a definition,George Mason proposed adding "mal-administration," but switched to "other high crimes and misdemeanors against the state" when Madison commented that "mal-administration" was too broad. A final revision defined impeachable crimes as "treason, bribery or other high crimes and misdemeanors."

See more on Impeachment: SENATE.GOV - Impeachment

"There is evidence that the Founding Fathers were intentionally vague. Initially, the framers considered defining impeachable offenses as just "treason or bribery" (rather than the ultimate definition of "treason, bribery, or other high crimes and misdemeanors"). They tacked on the additional phrase because George Mason worried that "treason or bribery" was insufficient for removing a president who began to display dictatorial tendencies."
